Si tiene a Venezia, lunedì 13, a partire dalle ore 14.00, e martedì 14 dicembre 2021, presso la Scuola Grande San Giovanni Evangelista, la prossima conferenza dei ministri della Giustizia degli Stati membri del Consiglio d’Europa, primo appuntamento di livello ministeriale del semestre di presidenza italiana. L’incontro dal titolo “Crime and criminal justice – the role of restorative justice in Europe” ha come tema la giustizia riparativa.
Nella “Raccomandazione del Consiglio d’Europa” (adottata dal Comitato dei Ministri il 3 ottobre 2018, la giustizia riparativa è definita così: “Ogni processo che consente alle persone che subiscono un pregiudizio a seguito di un reato e a quelle responsabili di tale pregiudizio, se vi acconsentono liberamente, di partecipare attivamente alla risoluzione delle questioni derivanti dall’illecito, attraverso l’aiuto di un soggetto terzo formato e imparziale”.
La giustizia riparativa costituisce anche un capitolo della legge delega di riforma del processo penale in Italia, già approvata in Parlamento.
Ad aprire e chiudere i lavori delle due giornate, la ministra della Giustizia Marta Cartabia che riceverà le 40 delegazioni presso la Scuola Grande San Giovanni Evangelista a Venezia. A partire dalle ore 14.00 dopo i saluti, i momenti saranno scanditi da tre sessioni, la prima a partire dalle ore 14,45: “Towards a widespred use of restorative justice for juveniles in conflict with the law and juvenil victims of crime”, la seconda alle 16.45: “Towards a widespred use of restorative justice as a complement of the criminal justice system to underpin its reform aiming at desistancee from crime, victims’ recovery, and offenders’ redress and reintegration”. La terza sessione nella giornata di martedì 14 dicembre alle ore 10.00 verterà su: “Towards a widespred training in restorative justice as a key to implement CoE recommendation (2018)8)”. I lavori di chiusura sono previsti dalle ore 12,00 alle 12,30. Nella serata di Lunedì 13 dicembre, le delegazioni ministeriali presenti potranno ascoltare due testimonianze sul percorso di giustizia riparativa vissuto nel Sud Africa dell’Apartheid, nel dialogo tra l’ex giudice costituzionale Albie Sachs e la prof.ssa Pumla Gobodo-Madikizela con Mario Calabresi.

The next Conference of the Ministers of Justice of the Member States of the Council of Europe, the first ministerial-level meeting of the semester of the Italian Presidency, will be held in Venice on Monday 13, starting at 2 p.m., and on Tuesday 14 December 2021, at the Scuola Grande San Giovanni Evangelista. The meeting entitled "Crime and criminal justice - the role of restorative justice in Europe" will focus on restorative justice.
In the "Council of Europe Recommendation" (adopted by the Committee of Ministers on 3 October 2018, restorative justice is defined as follows: "restorative justice is understood as a method through which the needs and interests of all the parties involved (victim, offender and the wider community) can be identified and satisfied in a balanced, just and collaborative way...The term “restorative justice” refers to any process that enables persons who suffer harm as a result of an offence and those responsible for that harm, if they freely consent to it, to actively participate in the resolution of issues arising from the offence, through the help of a trained and impartial third party”.
Restorative justice is also an important chapter of the enabling Act for the reform of the criminal trial in Italy, already approved in Parliament.
The two-day event will be opened and closed by Justice Minister Marta Cartabia, who will receive the 40 delegations at the Scuola Grande San Giovanni Evangelista in Venice. After the welcome message at 2 p.m., the event will be marked by three sessions, the first starting at 2.45 p.m.: "Towards a widespread use of restorative justice for juveniles in conflict with the law and juvenile victims of crime", the second at 4.45 p.m.: “Towards a widespread use of restorative justice as a complement of the criminal justice system to underpin its reform aiming at desistance from crime, victims' recovery, and offenders' redress and reintegration”. The third session on Tuesday 14 December at 10.00 a.m. will focus on: “Towards a widespread training in restorative justice as a key to implement CoE recommendation (2018)8)”. The closing session is scheduled from 12.00 to 12.30 p.m.
