Practical instructions – Multilingual standard form and certificate related to the absence of criminal records.
 

The Italian nationals that are to submit in another Member State the documents attesting the absence of prior records can use the multilingual standard form to be annexed to the criminal records.

The EU Regulation 2016/1191 of the European Parliament and the Council of 6 July 2016 enhanced the free circulation of the citizens of the Member States of the Union  and provided for the simplification of the requirements and administrative formalities for the circulation of some public documents issued by an authority of one Member State in view of submitting them in another Member State. This regulation established the multilingual standard forms to be used as support for the translation, to be annexed to public documents issued by an authority of a Member State attesting one or more of the following facts:

a) birth; b) a person being alive; c) death, d) name; e) marriage including capacity to marry and marital status, f) divorce; personal separation or annulment of marriage; g) registered partnership including capacity to enter into a registered partnership and registered partnership status; dissolution of a registered union, personal separation or annulment of a registered union; i) filiation; l) adoption; domicile and/or residence and absence of a criminal records;

for the purposes of submitting them in another Member State. The multilingual standard form shall be drafted in the language of the receiving State. Each form contains one standard part and another non-standardized part, made of specific headings per country reflecting the content of the public document to which the form is to be annexed.

In particular the form related to the absence of criminal records in the Member State of nationality of the person concerned can be found in Annex XI.

It can be requested to the Offices competent for issuing the certificate of judicial records.

The form delivered shall contain the date of issuance the official’s signature and the stamp of the issuance authority and shall be annexed to the certificate of judicial records.

No additional cost to that of issuance of the certificate is now provided for.

The form shall be drafted in each of the official languages of the European Union institutions, for the only purpose to facilitate the translation of the public documents to which it is annexed. Therefore, these forms shall not circulate as autonomous documents between the Member States.
 

N.B. The Regulation above shall not apply to the public documents issued by the authorities of a third country or to the certified copies of these documents produced by the authorities of a Member State or to the recognition in one Member State of the legal effects related to the content of the public documents issued by the authorities of another Member State.
