Il 15 e 16 settembre 2016,
alcuni rappresentanti del dipartimento della Lettonia Court Administration hanno visitato il Ministero della giustizia e la Corte Suprema di Cassazione,
per conoscere l'esperienza italiana, con particolare interesse per le
soluzioni che rendono disponibili le sentenze agli operatori del mondo giustizia e agli utenti in generale.

 

L’incontro ha rappresentato un utile scambio di esperienze e di condivisione dei benefici che derivano dalla diffusione in ambito internazionale della codifica ECLI.

L’attuazione del sistema ECLI in Lettonia è realizzato nel quadro dei progetti di giustizia transnazionale PROGRAMMA GIUSTIZIA (2014-2020) dell'Unione Europea.

A marzo 2016, la Court Administration della Lettonia ha avviato il progetto di interscambio delle esperienze su European Case Law Identifier (ECLI) per la codifica unica europea dei procedimenti giudiziari.

A settembre 2016, è previsto il primo incontro, in Italia, di allineamento e scambio di informazioni e procedure adottate nei rispettivi Paesi, tra i rappresentanti della Court Administration della Lettonia e del Ministero della giustizia.


Obiettivi : diffondere l’uso del Case Law Identifier o ECLI europeo per facilitare la corretta rappresentazione degli elementi caratterizzanti i procedimenti giudiziari.
L’uso dell’ECLI da parte di un alto numero di Paesi comporterà un beneficio per tutti gli aderenti, perchè, stabilendo standard univoci di classificazione, faciliterà la consultazione delle decisioni giudiziarie a livello internazionale e in tempo reale.

In particolare il progetto intende:

  • promuovere una prassi giudiziaria comune tramite l’applicazione e l’interpretazione della legislazione europea
  • promuovere la corretta ed uniforme codifica della classificazione dei procedimenti
  • migliorare i processi giurisdizionali nazionali attraverso la facilitazione dell’accesso alle decisioni di altri Paesi

Ministry of Justice of Italy cooperates with the Court Administration Republic of Latvia

Court Administration Republic of Latvia experts get acquainted with the Italian experience of implementation of European Case Law Identifier

In September 2016 experts of Court Administration Republic of Latvia visited the Ministry of Justice of Italy and Supreme Court of Italy in order to get acquainted with Italian experience in implementation of ECLI or European Case Law Identifier.

Latvian delegation discussed with representatives of Ministry of Justice of Italy ECLI implementation experience, with particular attention to IT solutions that ensure the availability of judgments for employees of the judicial system and, in some cases, as publicly available information. Italian colleague’s presented to Latvian delegation also the court judgments electronization and storage process. During the visit Latvian side from the Italian representatives got confirmation that additional benefits of the implementation of ECLI is a lot easier identification of judgments, which facilitates the application of particular case law. ECLI code application for the judgments also helps for statistical purposes - not only with regard to all judgments together, but also statistics relating to the most specified references to certain decisions. In this way, it is evident to which judgments are the most relied on and which the most authoritative judges are.

Latvian delegation whereas presented to Italian colleagues Latvian court system and the basic functions of Court Administration Republic of Latvia, as well as new technologies which make more efficient the work of courts.

Implementation of European case law identifier in Latvia is realized in the framework of National or transnational e-Justice projects JUSTICE PROGRAMME (2014-2020) of the European Union.

The project has been launched in March this year and it is scheduled to conclude in September 2017. Partners of Court Administration Republic of Latvia in this project are the National Courts Administration of Lithuania, Ministry of Justice of Italy, and Documentary Centre for the Judiciary, Spanish General Council.

In March 2016 Court Administration Republic of Latvia launched the project according to which Latvia will implement European Case Law Identifier or ECLI

Project summary (justification): the project's overall objective is to implement the European Case Law Identifier or ECLI to facilitate the correct and straightforward presentation of references with regard to judicial decisions. ECLI will provide easy access to both the Latvian and other EU member states judicial decisions that improve judges' expertise to EU law resorting and implementation, as well as ensuring uniform access to the database of court decisions already at the hearing.
Project goal:

  • promote a common judicial practice by applying and interpreting European legislation;
  • promoting correct and clear judgment quoting from the European and national courts by implementing of ECLI in Latvia;
  • improve the adjudication procedure and make more effective judicial decision-making procedure.

Within the project experience exchange visit is planned to the Ministry of Justice of Italy in September, 2016.
